These Terms and Conditions apply to all services provided by RadiantViewâ„¢ Wellness Ultrasound LLC, RadiantView Ultrasound, and their owners, employees, contractors, technologists, affiliated physicians, interpreting radiologists, and service providers (collectively, "RadiantViewâ„¢").

Nature of Screening Services

The ultrasound examinations provided by RadiantViewâ„¢ are screening services intended for preventative and informational purposes only. These examinations are not diagnostic studies and are not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition. Screening services are not a substitute for physician-directed medical care, diagnostic imaging, treatment, or emergency medical evaluation.

Patients should consult with their physician or qualified healthcare provider regarding any symptoms, concerns, abnormal findings, or changes in their health status regardless of the results of a screening examination.

Screening Limitations

The patient understands and acknowledges that no screening examination can detect all abnormalities or medical conditions. Ultrasound technology has inherent limitations, and false-positive, false-negative, incomplete, or inconclusive findings may occur.

A normal screening result does not guarantee the absence of disease, cancer, vascular disease, or any other medical condition.

Technical Limitations

Image quality and examination completeness may be affected by factors including, but not limited to, body habitus, breast density, implants, scar tissue, prior surgery, anatomical variations, patient movement, bowel gas, technical limitations, or other factors beyond the control of RadiantView. Such factors may limit the ability of the examination to identify abnormalities.

Independent Interpretation Services

Ultrasound images may be electronically transmitted to independent interpreting physicians and contracted radiology service providers, including EMSOW, for professional interpretation and report generation. Such providers are independent contractors and are not employees of RadiantView.

Interpretations are based solely on the images obtained during the examination and the information provided by the patient.

Interpretation and Recommendations

Reports and recommendations are based solely upon the images obtained during the examination. Depending on the findings, additional diagnostic imaging, laboratory testing, physician consultation, biopsy, or other medical evaluation may be recommended.

RadiantView does not guarantee any particular outcome, diagnosis, prognosis, or treatment result.

Significant Findings

If findings are identified that may warrant prompt medical attention, RadiantView or the interpreting physician may attempt to contact the patient using the contact information provided. However, the patient remains solely responsible for maintaining accurate contact information and obtaining appropriate medical follow-up.

The inability to contact a patient shall not create additional liability for RadiantView, EMSOW, interpreting physicians, technologists, contractors, or affiliated providers.

Follow-Up Responsibility

The patient understands and agrees that they are solely responsible for obtaining appropriate medical evaluation, follow-up care, and treatment recommendations from their physician or healthcare provider.

Failure to seek timely medical evaluation may result in delayed diagnosis, progression of disease, or other adverse outcomes for which RadiantView shall not be responsible.

Emergency Disclaimer

These screening examinations are not intended for emergency medical conditions or urgent medical concerns.

Patients experiencing severe pain, acute symptoms, chest pain, shortness of breath, neurological symptoms, sudden changes in health status, or other medical emergencies should immediately contact their physician, seek emergency medical attention, or call 911.

No Physician-Patient Relationship

Use of RadiantView's screening services does not establish an ongoing physician-patient relationship with RadiantView, its technologists, interpreting radiologists, medical directors, contractors, or affiliated providers.

Patient Information

The patient is responsible for providing accurate and complete health history, contact information, and other information requested in connection with the examination.

RadiantView shall not be responsible for delays, errors, or limitations resulting from inaccurate, incomplete, or outdated information provided by the patient.

Consent to Examination

The patient voluntarily consents to the ultrasound examination and acknowledges that the procedure is non-invasive and generally considered low risk.

The patient confirms that all information provided is accurate and complete to the best of their knowledge.

Incidental Findings

The patient understands that incidental or unexpected findings unrelated to the purpose of the screening examination may be identified. Recommendations for additional evaluation may be made based upon such findings.

Results Delivery

Reports are generally delivered within the estimated turnaround time communicated at the time of service. However, delays may occur due to technical issues, operational requirements, physician review, quality assurance processes, or circumstances beyond RadiantView's control.

Electronic Communication Consent

By providing an email address, telephone number, or other electronic contact information, the patient consents to receiving reports, appointment confirmations, scheduling updates, reminders, invoices, educational materials, and other communications electronically, including by email and text message where applicable.

The patient acknowledges that electronic communications may involve inherent privacy and security risks despite reasonable safeguards.

Electronic Storage and Transmission

The patient consents to the electronic collection, storage, transmission, processing, and retention of images, reports, and related health information for purposes including interpretation, report generation, quality assurance, healthcare operations, record retention, and regulatory compliance.

Privacy Practices

Patient information is handled in accordance with applicable federal and state privacy laws and RadiantView's privacy practices.

Patient records, images, reports, and related information may be stored electronically and shared with interpreting physicians, contracted radiology providers, referring physicians, healthcare providers, regulatory agencies, and authorized entities as necessary for treatment, payment, healthcare operations, legal compliance, or other permitted purposes.

Medical Record Retention

Images, reports, and related records may be retained for the period required by applicable laws, regulations, and professional standards. After the applicable retention period expires, records may be securely destroyed in accordance with RadiantView policies and legal requirements.

Financial Responsibility

The patient understands that screening services may not be covered by insurance and agrees to remain financially responsible for all fees associated with services rendered unless otherwise agreed to in writing.

RadiantView does not bill insurance and makes no representations regarding reimbursement by any insurance carrier, health plan, flexible spending account, health savings account, or other third-party payer.

Cancellation and Rescheduling

Appointments canceled or rescheduled without adequate notice may be subject to cancellation fees, rescheduling fees, forfeiture of deposits, or other charges as disclosed at the time of scheduling.

No Warranty or Guarantee

RadiantView makes no representations, warranties, or guarantees regarding the detection, exclusion, diagnosis, prognosis, treatment, or outcome of any medical condition based upon the services provided.

Website Information Disclaimer

Information provided on the RadiantViewâ„¢ website, social media platforms, educational materials, advertisements, or other communications is intended solely for general informational and educational purposes and should not be considered medical advice.

Reliance upon such information is solely at the user's own risk.

Photography and Recording

Patients may not photograph, record, reproduce, or distribute images, audio recordings, video recordings, examination procedures, equipment, software, reports, or staff interactions without prior written authorization from RadiantView.

Release of Liability

To the fullest extent permitted by law, the patient releases, waives, and holds harmless RadiantViewâ„¢ Wellness Ultrasound LLC, its owners, employees, technologists, independent contractors, interpreting physicians, EMSOW, affiliated providers, and service providers from any claims, demands, damages, losses, liabilities, costs, or expenses arising from:

• Limitations inherent in screening examinations;
• False-positive, false-negative, incomplete, or inconclusive findings;
• Failure to seek medical follow-up;
• Delayed diagnosis or treatment;
• Technical limitations affecting image quality;
• Communication failures resulting from inaccurate patient information; or
• Reliance upon screening results.

Nothing in these Terms shall limit liability for gross negligence, willful misconduct, or any liability that cannot legally be waived under applicable law.

Modification and Termination

RadiantViewâ„¢ Wellness Ultrasound LLC reserves the right to modify, update, suspend, discontinue, or terminate any aspect of its services or these Terms and Conditions at any time without prior notice.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California. Any dispute arising out of or relating to the services provided by RadiantView shall be subject to the exclusive jurisdiction of the courts located within the State of California, unless otherwise required by law.

Intellectual Property

All content, materials, trademarks, service marks, logos, text, graphics, reports, website content, educational materials, and other intellectual property belonging to RadiantView Wellness Ultrasound and RadiantView Ultrasound remain the exclusive property of RadiantView and are protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, published, displayed, or used without prior written permission.

Acknowledgment

By scheduling, purchasing, receiving, or participating in any service provided by RadiantViewâ„¢ Wellness Ultrasound LLC or RadiantView Ultrasound, the patient acknowledges that they have read, understood, and agreed to these Terms and Conditions and consent to the services described herein.
